NO PURCHASE NECESSARY TO ENTER OR WIN

 

1. SWEEPSTAKES PERIOD: The Laffy Taffy® The Last Laff Sweepstakes (the “Sweepstakes”) starts September 28, 2023 at 7:00 p.m. Eastern Time (“ET”) and ends October 13, 2023 at 6:59 p.m. ET (“Sweepstakes Period”). Sponsor will have the sole discretion in determining the timeliness of any action or inaction related to this Sweepstakes.
   
    
2. ELIGIBILITY: The Sweepstakes is open only to legal residents of the 50 United States or the District of Columbia, who are, as of date of entry, at least twenty-one (21) years of age or older as of date of entry. Employees of Ferrara Candy Company (the “Sponsor”), Don Jagoda Associates, Inc., their respective affiliates, parents, subsidiaries, divisions, suppliers, distributors and advertising, promotional and judging agencies (collectively, the “Sponsor and its Administrators”), and its affiliates and each of their respective employees, shareholders, directors, officers, members, assigns and agents and their immediate family members and/or those living in the same household of each are not eligible to participate or win. Void where prohibited by law. Sweepstakes is subject to all applicable federal, state and local laws.
   
    
3. OVERVIEW/HOW TO ENTER: Each day at 7:00 p.m. ET during the Sweepstakes Period, the Sponsor will post a joke on laffytaffy.com/lastlaff (the “Site”). To enter, follow the prompts on the Site to correctly answer the joke. If you answer correctly, you will be instructed to complete the registration form (“Registration Form”). Entrants will have unlimited chances to correctly answer the joke. By completing the Registration Form, you will receive one (1) entry (“Entry”) into the random drawing. You must respond with the correct answer to proceed with Entry.
   
   Limit one (1) Entry per person per Entry Period. For the purposes of this Sweepstakes, an “Entry Period” is defined as the 24-hour period beginning at 7:00 p.m. ET and ending at 6:59 p.m. ET on the following day. Any attempt by any entrant to obtain more than the stated number of Entries by using multiple/different email addresses, identities, registrations and logins, or any other methods will void such Entries and that entrant will be disqualified. Normal Internet/phone access and data/usage charges imposed by your online/phone service provider will apply. All Entries must adhere to the Official Rules of the Sweepstakes. Any Entry that does not adhere to the Official Rules is subject to disqualification from the Sweepstakes.  By entering, you agree that you are solely responsible for all internet access and data charges that you incur. All such charges are billed by and payable to your internet or mobile service provider. Please contact your participating service provider for pricing plans, participation status and details. Entries will not be acknowledged or returned. Sponsor and its Administrators are not responsible for lost, late, incomplete, invalid, unintelligible or misdirected Entries, which will be disqualified. Any use of robotic, repetitive, automatic, programmed or similar Entry methods or agents (including, but not limited to, sweepstakes entry services to create fraudulent email addresses, and/or identities) will void all Entries by that entrant. In the event of a dispute as to any Entry, the authorized account holder of the email address used to enter will be deemed the entrant. “Authorized Account Holder" is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. Potential winners may be required to show proof of being the Authorized Account Holder associated with the Entry.
   
    
4. RANDOM DRAWING: One (1) Grand Prize winner and five hundred (500) First Prize winners will be selected in a random drawing to be held on or about October 16, 2023 from among all eligible Entries received. The odds of winning will depend on the number of eligible Entries received throughout the Sweepstakes Period. The random drawing will be conducted by an independent judging organization whose decisions are final on all matters relating to the Sweepstakes. Limit one prize per person/household. In the event that an insufficient number of eligible Entries are received to award all available prizes, Sponsor is not obligated to award any remaining prizes.
   
    
5. PRIZES AND APPROXIMATE RETAIL VALUES (“ARV”):
   
   a. GRAND PRIZE (1): $5,000, awarded in the form of a check made payable to the winner, a Sponsor-selected prize pack containing a game and Laffy Taffy product, and a four (4) day/ three (3) night trip for winner and three (3) travel companions [each a “Guest(s)“] to the Greater Los Angeles, CA area for a meet and greet with a Sponsor-selected celebrity. Trip includes roundtrip economy air transportation from a major airport nearest winner’s home to the greater Los Angeles, CA area and returning to a major  airport nearest winner’s home from the greater Los Angeles, CA area, three (3) nights’ hotel accommodations (quad occupancy), a meet and greet for winner and Guest(s) with a Sponsor-selected celebrity, including games (the “Meet and Greet”), dinner at a Sponsor-selected restaurant,  and a $250 transportation gift card  (ARV: $11,850).  In the event the celebrity is unavailable or Sponsor-selected Meet and Greet is cancelled for reasons outside of the Sponsor’s control, that portion of Grand Prize will not be awarded and no additional compensation will be provided to winner. Grand Prize winner’s Guest(s) (or winner as parent/legal guardian of any minor Guest) must execute and return a liability/publicity release prior to travel. The Grand Prize winner and their Guest(s) are solely responsible for all other expenses not specifically set forth herein, including but not limited to meals, upgrades, travel insurance, meals, in-room charges (e.g. mini-bar, movies), alcoholic beverages, telephone calls, merchandise, souvenirs, personal expenses, laundry service, spa treatments, tips and gratuities, incidental charges, parking, surcharges, service charges, personal charges, taxes, travel and other insurance, additional transportation, gratuities, souvenirs, upgraded room accommodations and other incidentals and items of a personal nature or any other item not specifically described in these Official Rules, and all expenses for any of the foregoing are solely the responsibility of the Grand Prize Winner. Sponsor is not responsible for lost, mutilated or stolen travel documents. Sponsor is not responsible for airline cancellations, blackout dates, delays, diversions or substitutions and no refund or compensation will be awarded in any such event. The Grand Prize winner and their Guest(s) must travel on the same itinerary and must agree to depart and return on same dates. Travel must be complete by December 31, 2023 and is subject to availability and blackout dates. Grand Prizes are subject to additional restrictions.  All travelers must pass any required medical testing and comply with any requirements, at any time, that may be required or recommended by any government agency, airline, or Sponsor, including without limitation, passing one or more COVID-19 antigen and screening tests, and testing negative for COVID-19 or having the COVID-19 vaccine(s). Travelers may also be required to execute any assumption of risk and/or other documents relating to COVID-19 or they may not be permitted to travel or participate in Sponsor-specified tour or excursion. Such failure to qualify or comply will result forfeiture of that portion of the Grand Prize in its entirety with no additional compensation, and no substitution will be provided, except in Sponsor’s sole determination. In the event that any Grand Prize winner or their Guest(s) engage in behavior that (as determined by Sponsor in Sponsor’s sole discretion) is inappropriate or threatening, illegal or that is intended to annoy, abuse, threaten or harass any other person, Sponsor reserves the right to terminate the trip early and/or eject them any Sponsor-specified tour or excursion, in whole or in part, and send the Grand Prize winner and their Guest(s) home with no further compensation to the Grand Prize winner. Grand Prize consists of only the items specifically listed as part of the prize in these Official Rules and prize details not specified herein shall be determined solely by Sponsor. If the Grand Prize winner elects to make alternate arrangements for any portion of the Grand Prize for any reason whatsoever, no additional compensation will be awarded to the Grand Prize winner and Sponsor is not responsible for such alternate arrangements. Actual retail value of the Grand Prize may vary. Sponsor is not responsible for, and Grand Prize winner will not receive any difference between, the actual value and ARV of the Grand Prize.  If ground transportation is substituted in lieu of air transportation, the Grand Prize winner will not receive the difference between the value of the air transportation and the ground transportation. Sponsor will be booking air travel and hotel accommodations on behalf of the Grand Prize winner. No changes will be made to travel details once any element(s) of the travel arrangements have been booked, except at Sponsor’s sole discretion. The Grand Prize winner may be required to provide a major credit card upon hotel check-in or prior thereto and all in-room charges will be charged to the credit card (subject to terms and conditions of the hotel). Any damage to the room, and/or any other venue related to the prize, attributed to the Grand Prize winner and/or the Guest(s) will be the responsibility of the Grand Prize winner. Sponsor is not responsible for the availability or proper functioning of any hotel feature or amenity and no credit or compensation will be awarded by Sponsor with respect thereto. Minor children may accompany the Grand Prize winner as a Guest(s) only if the minor’s parent or legal guardian is the Grand Prize Winner. The minor must be accompanied at all times during the trip (including, but not limited to, in-flight and hotel stay) by minor’s parent or legal guardian. If the Grand Prize winner elects to partake in the Grand Prize with no Guest(s), the remaining elements of the Grand Prize shall constitute full satisfaction of Sponsor’s prize obligation, and no additional compensation will be awarded to the Grand Prize Winner.
   
   Grand Prize winner and Guest(s) understand and agree that, as a condition of being awarded the prize/traveling as a Guest, Grand Prize winner and Guest(s) may be subject to a background check at the sole discretion of Sponsor; failure to comply may result in disqualification and forfeiture of prize (or inability to accompany Grand Prize winner). In addition, at the discretion of the Sponsor, potential Grand Prize winner and Guest(s) may be disqualified (or Guest may not be permitted to travel with Grand Prize winner): (a) if charged with or convicted of a felony or misdemeanor; (b) if Sponsor determines, in its sole discretion, that awarding the prize to such individual/traveling with Grand Prize winner may reflect unfavorably on the Sweepstakes or Sponsor; (c) if he/she is not eligible to receive the prize based on the eligibility requirements set forth in these Official Rules; (d) if Sponsor determines that he/she failed to comply with these Official Rules in any way; or (e) if he/she refuses to or cannot accept the prize for any reason. Potential Grand Prize winner and Guest(s) social media profiles must be in keeping with the Sponsor’s image or they may be disqualified, in Sponsor’s sole discretion.
   
   RELEASED PARTIES SHALL NOT HAVE ANY LIABILITY FOR ANY PERSONAL INJURIES, DEATH, PROPERTY DAMAGE, OR OTHER DAMAGES OR EXPENSES RESULTING FROM OR ARISING OUT OF OR RELATED TO THE GRAND PRIZE OR ANY ACTIVITY RELATED TO THE GRAND PRIZE OR ANY OTHER ASPECT OF GRAND PRIZE WINNER’S ACCEPTANCE OR USE OF THE PRIZE, INCLUDING TO WINNER’S GUEST(S).
   
   b. FIRST PRIZES (500 total): A Sponsor-selected prize pack containing a game and Laffy Taffy products (ARV: $50 each). Prizes may be substituted for any reason only at the discretion of the Sponsor.
   
   The total ARV of all prizes is $36,850. Prizes are nontransferable and no substitutions are allowed except by the Sponsor, who reserves the right to award a prize of equal or greater value. The prizes being awarded have no cash value and may not be redeemed for cash at any time. The resale or auction of prizes will result in the winner’s disqualification from all future sweepstakes and contests of Sponsor. All applicable federal, state, and local income taxes for acceptance and use of the prizes are the sole responsibility of winners. The Grand Prize winner will be issued a 1099 tax form for the value of their prize. Prizes are awarded “as is” without any warranty or guaranty of any kind. To the extent that prize elements are provided by third-party providers, winners agree to look solely to applicable prize providers with respect to any claims, losses, or disputes in connection therewith. All prize details not specified in these Official Rules will be determined in Sponsor’s sole discretion.
   
    
6. WINNER NOTIFICATION/VERIFICATION: The potential Grand Prize winner will be sent, via email link, a Declaration of Eligibility, Liability & Publicity Release (where legal), and must provide identification (e.g., via valid state-issued driver’s license, passport or other government-issued I.D. containing the person’s name, date of birth, and photograph) (collectively, “Declaration”) and will be required to complete, and sign and return the Declaration via email within forty-eight (48) hours of being notified in order to claim his/her prize. Grand Prize winner’s Guest(s) (or winner on behalf of minor Guest) must sign and return a Liability and Publicity Release (where lawful), prior to travel. If the potential Grand Prize winner/Guest(s) fail to return the Grand Prize winner Declaration and the Guest waiver within the required time period, or the prize notification is returned undeliverable, or in the event that the potential Grand Prize winner is disqualified for any reason, Sponsor will award the applicable prize to an alternate winner selected by a random drawing from among all remaining eligible Entries received. Potential First Prize winners will be notified by email and the First Prize will be awarded to the Authorized Account Holder of the e-mail address submitted with the Entry regardless of the individual who submitted the winning Entry.  First Prizes will then be shipped to winners to the mailing addresses provided at the time of registration within eight-ten weeks of the conclusion of the Sweepstakes.  If any prize or prize notification is returned as undeliverable, and/or if potential winner is not in compliance with the Official Rules (including eligibility requirements), then the potential winner will be disqualified and an alternate potential winner will be randomly selected from among remaining eligible, non-winning entrants, time permitting. Prizes will be awarded provided a sufficient number of eligible Entries are received throughout the Sweepstakes Period. Winners are subject to verification by Sponsor and/or Administrator, whose decisions are final and binding in all matters related to the Sweepstakes.

 

7. GENERAL RULES: By participating in this Sweepstakes, entrants and winners agree to be bound by these Official Rules and the decisions of the Sponsor. All applicable laws and regulations apply. Entrants and winners hereby hold the Sponsor and its Administrators and each of their respective officers, directors, members, managers, employees, agents, representatives, successors and assigns (the “Released Parties”) harmless from and against any third party claim arising from use of any Entry and entrants and winners waive any right to inspect or approve uses of their Entry by Sponsor in connection with the Sweepstakes or to be compensated for any such uses. Participating in the Sweepstakes constitutes permission to the Sponsor to use an entrant’s and winners’ names, addresses, and likenesses in connection with the administration of the Sweepstakes only and as otherwise required by law. By participating in the Sweepstakes, the entrants and winners and Guests agree that Released Parties will have no liability whatsoever for, and will be held harmless by entrants and winners/Guests for any liability for any bodily injury, loss or damages of any kind to persons, including death, and property, due in whole or in part, directly or indirectly, from submitting an Entry, the acceptance, receipt, redemption, possession, ownership, use or misuse of any prize, if applicable, or participation in the Sweepstakes or participation in any Sweepstakes related activity. You hereby represent and warrant that you have read these Official Rules and are fully familiar with their contents and agree to be bound by them. This Sweepstakes is in no way sponsored or administered by the Sponsor-selected celebrity. The Sponsor is not responsible for any typographical or other error in the printing of the Sweepstakes materials or the offering or announcement of the prizes. Sponsor reserves the right to cancel or modify the Sweepstakes if fraud, misconduct or technical failures threaten the integrity of the Sweepstakes; or if a computer virus, bug, or other technical problem corrupts the administration or security of the Sweepstakes as determined by Sponsor, in their sole discretion. In the event of termination, a drawing for the prizes will be conducted from among all eligible Entries received prior to termination. Sponsor reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Sweepstakes; violates the Official Rules; acts in an unsportsmanlike or disruptive manner; or acts in an annoying, abusive, threatening, or harassing manner. If a dispute arises regarding compliance with these Official Rules, Sponsor may consider, in its sole discretion, data reasonably available to Sponsor through information technology systems in Sponsor’s control, but Sponsor will not be obligated to consider any data or other information collected from any other source. Any failure by Sponsor to enforce any of these Official Rules will not constitute a waiver of such Official Rules. If there is a conflict between any term of these Official Rules and any marketing or other materials used in connection with the Sweepstakes, the terms of these Official Rules will govern. The Released Parties are not responsible for technical, hardware or software malfunctions, telephone failures of any kind, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled or delayed electronic communications, whether caused by the sender, by any of the equipment or programming associated with or used in the Sweepstakes that may limit the ability to participate, or by any human error which may occur in the processing of the Entries in the Sweepstakes. Entries generated by script or bot are not eligible. Sponsor reserves the right to cancel, terminate or modify the Sweepstakes if it cannot be completed as planned for any reason, including but not limited to infection by computer virus, bugs, tampering, unauthorized intervention, technical failures, or corruption of any sort. In such event, Sponsor will award the prizes in a random drawing from non-suspect, eligible Entries received prior to cancellation as outlined above, provided it is able to do so, and will announce the termination on the Site. Sponsor also reserves the right, in its sole discretion, to modify these Official Rules for clarification purposes without materially affecting the terms and conditions of the Sweepstakes. If any provision(s) of these Official Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.

 

8. DISPUTES: Except where prohibited, entrant agrees that: (1) all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prize awarded must be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the District of Illinois or the appropriate State Court located in Cook County, Illinois, and Entrants consent to the mandatory and exclusive jurisdiction of such courts with respect to any such legal proceedings ; (2) all claims, judgments and awards will be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys' fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSIONS OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY. CHECK LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, will be governed by, and construed in accordance with, the laws of the State of Illinois, without giving effect to any choice of law or conflict of law rules (whether of the State of Illinois or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Illinois.

 

9. PRIVACY: Information collected from entrants is subject to Sponsor’s Privacy Policy, located at https://www.ferrarausa.com/privacy-policy.html.

 

10. WINNERS: For the names of the winners (“Winners List”), available for ninety (90) days after November 1, 2023, send an email to: Winners@dja.com with “Laffy Taffy The Last Laff Sweepstakes” as the subject line. Winners List will be sent after the prizes have been awarded.
